LEGISLATION

The Virginia Alliance Against Assisted Suicide

Background:

Since it was first enacted in 1998, Virginia has made it illegal by law to assist another person to commit or attempt to commit suicide within the commonwealth. Anyone, even a healthcare provider – who assists another in attempting suicide is liable for compensatory and punitive damages as well as professional discipline up to and including license revocation.  Additionally, the person who aids another in attempting a suicide is subject to an injunction, and/or potentially criminal penalties. "Suicide" means the act or instance of taking one's own life voluntarily and intentionally.  This 1998 law was approved by massive majorities in the General Assembly – passing in the Senate, 34-6 and the House, HB 858, 89-6.

Legislation:

Legislation to legalize assisted suicide has been introduced five times in the last seven years. In 2024, it even passed the Senate (SB 280) [21-19] before failing in the House. (See also HB 858). We anticipate this legislation will be reintroduced at some point in the future, possibly in 2026.
